In federal court pleadings yesterday, DHS admitted that it deported Mr. Kilmar Abrego Garcia to El Salvador…by mistake. Meaning that they knew he had been granted “withholding of removal” by an Immigration Judge in 2019. Legally, this meant that DHS was prohibited by law from deporting Kilmar to El Salvador. They did it anyway. “Through administrative error, Abrego-Garcia was removed from the United States to El Salvador. This was an oversight, and the removal was carried out in good faith… .” - Declaration of Robert L. Yesterday, in a blistering, 78-page opinion, federal District Judge Edward M. Chen protected over 300,000 Venezuelans in the USA from the predations of DHS Sec. Kristi (“ICE Barbie”) Noem…at least temporarily.
Also yesterday, a team from WilmerHale won a victory in the First Circuit, Alvarez-Mendoza v. Bondi. Hats off!
